Terms & Conditions - Accredited Training

TERMS

Us – Lesley Graham Training and Consulting Pty Ltd (referred to hereafter as Us or We or LGTC)
You – the student (referred to hereafter as You)
The Registered Training Organisation (referred to hereafter as the RTO). 

ACCREDITED TRAINING

How it works - Our accredited courses are offered through the RTO.  

The role of the RTO –

  1. ensures that the training and assessment We offer complies with national standards.
  2. manages Your enrolment and certification:
    • You pay the RTO for Your enrolment.
    • Your enrolment is subject to the terms and conditions of the RTO, You should read these through carefully.  The terms and conditions of the RTO will always supersede those of LGTC.
  3. will issue Your certificate when We advise them that You have achieved competency in the course.

Our role – We:

  1. provide Your course materials, training and assessment
  2. communicate with You in all matters relating to Your training.
  3. assess Your work and confirm Your competency to the RTO.

REFUNDS

In all cases requests for refunds must be made to the RTO.

CONFIRMATION OF ENROLMENT

We will contact You by email and/or SMS to confirm We have received enrolment details.  If You do not hear from Us in a reasonable period of time You should contact Us.
Once We confirm Your enrolment You are enrolled unless We tell You otherwise.

ASSESSMENT

To be deemed competent against a nationally accredited unit, You must be assessed for that Unit and must be competent in all elements that comprise that unit.
Assessment is carried out by competent assessors based on evidence of competence achieved through observation, testing, interview and/or review of records. Assessors use a range of knowledge and skill-based assessment processes and methodologies to obtain evidence of competence.

Assessment is planned and conducted in a manner that aims to ensure that it is fair; valid, reliable and sufficient.

A student will be assessed as either ‘COMPETENT’ or ‘NOT YET COMPETENT’ in each Unit undertaken.

If ‘COMPETENT’: You will be issued with either a ‘Statement of Attainment’ for units of competency within a qualification or a ‘Certificate’ for the full qualification.
If ‘NOT YET COMPETENT’: You will be advised of the areas where competency is yet to be achieved; and given further opportunity to achieve competency.

APPEALS, GRIEVANCES AND COMPLAINTS

Should You believe that You have sufficient grounds existing for an appeal of the outcome of an assessment, this should brought to the attention of, and discussed with, the trainer or assessor immediately. If there continues to be disagreement after reasonable discussion You should make the appeal, grievance or complaint in writing (marked ‘Confidential’) to the RTO.

RE-ASSESSMENT

If You do not successfully demonstrate competency for all required elements of a training course during the training period You may be eligible for re-assessment. The method for re-assessment will be dependant upon the performance criteria and will be discussed with You by Your assessor. If You elect to try for re-assessment You will be liable for any associated costs involved.

STUDENT CODE OF CONDUCT

The Student (You) Must:

  1. Understand and accept these terms and Conditions an any other enrolment conditions for the course You undertake.
  2. Provide accurate information about Yourself at enrolment
  3. Pay all fees associated with the course You undertake
  4. Advise Us of any change of contact details during the duration of the course.
  5. Provide work that is original and not copied or plagiarised
  6. Respect Your trainer and other students
  7. Complete the course in the required time.  (An extension of time may be available in some cases, this will need to be discussed with Your assessor).

Plagiarism - In the event that You are found by LGTC, Your trainer or the RTO to be plagiarising assessment material You may be requested to undertake the assessment again and the RTO may exercise it’s right to withhold Statements of Attainment and Certificates.

If a problem of compliance with the Code of Conduct is perceived the problem will be immediately brought to Your attention and discussed with You. LGTC reserves the right to advise the RTO of such problems.  In some instances the RTO may choose to withhold Statements of Attainment and Certificates, and LGTC may choose to terminate the training process; in this event no refund will be given.

STUDENT RIGHTS

You are entitled to:

  1. Learn in an environment free of discrimination, harassment, bullying or victimisation.
  2. Access our courses and services regardless of educational background, gender, marital status, sexual preference, race, colour, pregnancy, national origin, ethnic or socio-economic background, physical or intellectual impairment, and religious or political affiliation.
  3. Pursue learning goals in a supportive and stimulating environment.
  4. Privacy, concerning all Your personal records and information held by the RTO or LGTC
  5. Have Your prior learning, acquired competencies, and experience appropriately recognised in determining competency requirements for accredited courses.
  6. Expect to complete Your course training and assessment and achieve the published learning outcomes if You devote the necessary time and diligence to it and comply with Our terms and conditions.
  7. Learn from Well-qualified, competent and diligent tutors who observe their responsibility to address  Your learning needs, assist You to achieve published course outcomes, and assess Your work fairly.

VOCATIONAL EDUCATION AND TRAINING (VET)

Vocational Education and Training (VET) provides skills and knowledge for work. We offer nationally recognised qualifications under the Australian Qualifications Framework (AQF).
To be eligible to receive a certificate students must comply with AQF guidelines and requirements.
Additional documentation may be required if the training is supported by public funding.

RECOGNITION OF QUALIFICATIONS ISSUED BY OTHER REGISTERED TRAINING ORGANISATIONS

The RTO may recognise the AQF Qualifications and Statements of Attainment awarded by other Registered Training Organisations (RTOs). These must be authenticated by the provision of properly completed assessment records such as a Statement of Attainment. Verification from the issuing organisation of the Certificate or SOA may be requested.

RECOGNITION OF PRIOR LEARNING / CURRENT COMPETENCY

The RTO may allow Recognition of Prior Learning (RPL) and Recognition of Current Competencies (RCC).  Examples of the different types of evidence that may apply to the course that You are undertaking may be in the form of:

  1. Formal qualifications (Certificate/Statement of Attainment from other RTOs)
  2. Life Experiences
  3. Work History

Please speak to the RTO if You feel You may be eligible to gain RPL or RCC, and they will advise You of the process.  This could save You time and effort in completing the course.

RECORDS MANAGEMENT AND PRIVACY

Records of student VET training and assessment are held by the RTO as either hard copy (securely stored) and/or electronic files. All student records are confidential and distribution is strictly limited to:

You, LGTC, the RTO and various Government departments as required by legislation (accreditation, surveys and statistics)
If You wish to access Your records You should inform Your trainer / assessor who will make the arrangements.
Information will not be distributed to any other parties without the prior written authorisation of the Student. An example of when this is if Your employer has organised the training and wishes to have a record of Your training.

LEGAL AND OTHER REQUIREMENTS

LGTC & the RTO will comply with all legal requirements of Commonwealth and/or State & Territory legislation.


Terms & Conditions - Non-Accredited Training

TERMS

Us – Lesley Graham Training and Consulting Pty Ltd (referred to hereafter as LGTC or Us or We)
You – the student (referred to hereafter as You)

NON-ACCREDITED TRAINING

How it works - Our non-accredited courses are offered directly to You by LGTC.  When You successfully complete the course You will be issued with a Certificate of Completion.  NB – this is not a nationally accredited training certificate.

LGTC will:

  1. manage Your enrolment
  2. provide You with course materials and training
  3. communicate with You in all matters relating to Your training.
  4. check and confirm that You have successfully completed all units of the course.
  5. issue You a Certificate of Completion when You successfully complete the course.

CONFIRMATION OF ENROLMENT

We will contact You by email and/or SMS to confirm We have received enrolment details.  If You do not hear from Us in a reasonable period of time You should contact Us.
Refunds will not be considered once Your enrolment is confirmed.
Once We confirm Your enrolment You are considered to be enrolled unless We advise You otherwise.

SUCCESSFUL COMPLETION

To successfully complete the course You must complete each Unit of the course to the satisfaction of Your trainer.
Training is carried out by competent trainers who will review Your work, interview You, observe and test You. Trainers use a range of knowledge and skill-based training processes and methodologies to obtain evidence of successful completion.
Training is planned and conducted in a manner that aims to ensure that it is fair; valid, reliable and sufficient.
For each Unit undertaken You will be advised that it:

  1. has been successfully completed; or
  2. has not been successfully completed, and given further opportunity to complete it.

Your payment is for course materials and training provided, not for a Certificate. If You do not successfully complete the course in the required time no Certificate of Completion will be issued; in this event no refund will be given.

APPEALS, GRIEVANCES AND COMPLAINTS

Should You believe that You have successfully completed a unit but Your trainer does not believe that You have done so, You should bring this to the attention of the trainer.  If there continues to be disagreement after reasonable discussion, You should make an appeal, grievance or complaint in writing (marked ‘Confidential’) to the Manager, LGTC.
The Manager of LGTC will discuss the appeal, grievance or complaint with Your trainer and advise You, in writing, of the outcome as soon as is practically possible.  

RE-TRAINING

If You do not successfully complete all required elements of a training course during the training period You may be eligible for re-training. The method for re-training will be dependant upon the performance criteria and will be discussed with You by Your trainer. If You elect to try for re-training You will be liable for any associated costs involved.
